Cristian Valles Films

By booking the services of Cristian Valles Films, either directly or through platforms like FareHarbor, the client (hereinafter referred to as “the client” or “the clients”) acknowledges and agrees to the following terms and conditions:

1. Assignment of Photographer

Upon booking with Cristian Valles Films, a photographer from our professional staff will be assigned to the session. All team members have been carefully selected and trained under strict quality control standards to ensure technical, artistic, and customer service excellence in every production.

2. Intellectual Property

All photographs, videos, and images captured during the service are the exclusive intellectual property of Cristian Valles Films.

3. Authorized Use

The client grants Cristian Valles Films irrevocable permission to use, reproduce, and publish the captured images for promotional purposes, including but not limited to portfolio use, website galleries, and social media platforms such as Instagram, Facebook, TikTok, YouTube, and any other digital or marketing platforms.

4. Privacy and Waiver of Claims

Cristian Valles Films commits to using all images respectfully and professionally. By accepting these terms, the client waives the right to any legal claims, complaints, or compensation regarding the use of their images on legitimate platforms.

5. Non-Exclusivity

The client understands that Cristian Valles Films may use the images non-exclusively and continue to provide services to other clients.

6. Authorized Third-Party Use

The client authorizes Cristian Valles Films to share the images with partners such as the Hotel Alexander for promotional use on their websites or social media, or with some of our secondary photography or videography brands.

7. Consent from Participants

The client is responsible for obtaining consent from all participants involved in the session, including couples, family members, and especially the legal guardians of minors.

8. Dispute Resolution

Any disputes related to these terms shall be resolved through mediation under the laws and jurisdiction of Miami, Florida.

9. File Loss or Deletion

While Cristian Valles Films takes every necessary precaution to protect all captured files, in the unlikely event of technical failure, memory card damage, or theft, the client agrees to waive any claims or compensation beyond a full refund of the amount paid.

10. Force Majeure

Cristian Valles Films will not be held liable for delays or failure to provide services due to causes beyond our control, such as natural disasters, pandemics, war, or other force majeure events. In such cases, we will seek alternative solutions or issue a refund.

11. Professional Judgment and Available Material

We commit to capturing all necessary images based on our professional judgment and experience. If, due to circumstances beyond our control, certain images cannot be taken or completed, we will deliver the project using only the material effectively recorded during the session.

12. Voluntary Removal Requests

Although Cristian Valles Films retains legal rights to image usage, we will voluntarily consider reasonable requests for image removal, provided they are respectfully and clearly communicated. This does not imply obligation nor affect the remaining terms.

13. Technical Limitations

We are not responsible for any reduction in quality due to weather conditions, restricted access to locations, delays, or participant behavior that hinders the normal course of the session.

14. Terms Modification

We reserve the right to update or modify these terms and conditions at any time. Changes will take effect upon publication on our website.

15. Contract Language

This contract is originally drafted in English. In the event of any discrepancies with translations, the English version shall prevail.

16. Use of Artificial Intelligence

The client acknowledges and accepts that some images delivered may have been partially or entirely processed or enhanced using artificial intelligence tools. Likewise, promotional or advertising images—including those that led the client to this website—may have been generated, edited, or created using AI. This does not constitute misleading advertising or a violation of rights.

17. Social Event Coverage

For events such as weddings, quinceañeras, birthday parties, or other celebrations, Cristian Valles Films will make every effort to capture the most relevant moments. However, the client understands that the final photo and video delivery is a summarized version of the event, and the selection is made using our professional judgment. We do not guarantee coverage of every single moment or person.

18. Cancellations and Rescheduling

Cancellations must be made at least 72 hours in advance of the scheduled session. If not, no refund will be issued. However, the session may be rescheduled for another available date and time, depending on Cristian Valles Films’ availability.

19. Right to Interrupt the Session

Cristian Valles Films reserves the right to interrupt or cancel any session if the behavior of the client or accompanying individuals is inappropriate, disrespectful, or poses a risk to the team or equipment. In such cases, no refund will be provided.

20. Delivery Time

Final content will be delivered within approximately 7 to 15 business days, depending on the volume and type of editing required. Any extension will be communicated in advance.

21. Implicit Acceptance

By booking, making a payment, or attending the session—through any of our authorized platforms, including FareHarbor, Zelle, PayPal, credit cards, or others—the client confirms full understanding and acceptance of these Terms and Conditions.
